Q: What force does a letter of guarantee have?

In itself it does not create a new guarantee in the legal sense, but it confirms the debt. Acknowledging a debt interrupts the limitation period, and in court the letter serves as evidence that the debtor did not dispute the debt.

Q: Who signs the letter?

The director or a representative acting under a power of attorney. A court may refuse to treat a letter signed by someone without authority as an acknowledgement of the debt.

A letter in which a company confirms a debt and names the payment date. Suppliers ask for it in order to continue shipments or to avoid going to court.
